# Terms of Service — Aleatoria Issued: **12 October 2026** · Effective: **12 November 2026** · Version 1.1 · Translation of the Czech original , **which prevails in case of any discrepancy**. **Which version applies to you.** For a contract concluded (an account registered or a purchase made) **on or after 12 October 2026** this version 1.1 applies from the moment you accept it. For a contract concluded **before 12 October 2026**, version 1.0 of 10 September 2026 (with the price figures of §4 as updated on 27 September 2026) applies until 11 November 2026 inclusive and version 1.1 from **12 November 2026** — 30 days after this notice under §13. If you disagree with the change you may cancel your subscription before that date and we refund the pro‑rata part of the price for the unused period (§13). > **(k právní revizi / pending legal review)** Drafted by the engineering team from the actual behaviour of the > service and the price list (`docs/PRICING.md`, `server/aleatoria/plans.py`). Sections 7 (withdrawal), 8 (licence > to outputs) and 12 (liability) still need a lawyer's review. ## Version history | version | issued | effective | what changed | |---|---|---|---| | 1.0 | 10 Sep 2026 | 10 Sep 2026 | First release. On 27 September 2026 the price figures in §4 were updated to the new price list for new purchases (Studio €9.99 / CZK 249, Pro €29.99 / CZK 749 with 1,500 credits, top‑up €7.99 / CZK 199, AI studio tools 4 or 8 credits) without a change of the version number; subscriptions from before that date keep their original price and allowance (§4, "Price change of 27 September 2026"). | | 1.1 | 12 Oct 2026 | 12 Nov 2026 (a contract concluded from 12 Oct 2026: on acceptance) | **The service is paid‑only.** New entry plan **Basic** (€2.99 / CZK 79 a month, 100 credits a month, commercial use). **Free** is an account without a subscription that keeps its library and its downloads but **renders nothing while the paid‑only mode is in force**; the daily credit allowance the Free plan had in version 1.0 is withdrawn. The only free use is the anonymous **30‑second trial** without an account. Written down for the first time: the rule for subscriptions from before 27 September 2026, the daily procedural limit and its exception for subscriptions from before 8 October 2026 (§4), commercial use on Basic (§8), retention on Basic and of the trial (§12), how a price change of a running subscription is announced (§13). | The version history of these terms is kept in the project repository; the text of version 1.0 is available on request at support@aleatoria.io. ## 1. Who provides the service The provider is **Cloudpeakify s.r.o.**, company ID (IČO) **21041342**, VAT ID **CZ21041342**, registered seat **Jičínská 226/17, Žižkov, 130 00 Prague 3, Czech Republic**, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 396064 — "we", "the provider". Contact: **support@aleatoria.io**. Write to that address about anything — questions about the service, defects, withdrawal from the contract, personal data and security reports alike. For consumer disputes the supervisory body is the Czech Trade Inspection Authority ([coi.cz](https://www.coi.cz/)); out‑of‑court dispute resolution is described in §14. ## 2. What Aleatoria is Aleatoria is a web music studio that generates music and nature sounds from your input. * **Procedural (Tier 0) engines** — our own algorithmic synthesis; always available and **cost no credits**. * **Neural (Tier 1) engines** — optional third‑party models (ACE‑Step, Stable Audio Open, HeartMuLa, MusicGen); they consume credits and may be temporarily unavailable. * Outputs: 24‑bit WAV and FLAC (44.1 / 48 / 96 kHz), 320 kbps MP3, stems, MIDI, score JSON and immersive masters (binaural, 7.1.4, "Atmos‑ready" ADM BWF, AmbiX). The service is provided "as is" and evolves continuously. Engine availability may change; we announce material restrictions of features you have paid for in advance (§13). ## 3. Your account The account is personal. You can sign in with a **password**, with a **one-time link sent by e-mail** or with a **Google account**, and you can additionally issue an **API key** for your own tools. That means one practical duty: **protect your mailbox as carefully as your password** — whoever reaches it can sign in by link without knowing the password. Protect your API key — whoever holds it can spend your credits. The key does not expire; it is shown once when it is issued, and you can issue a new one at any time (which invalidates the previous one) or revoke it. A password reset and "sign out everywhere" **also revoke the API key**, together with every session. Report loss or misuse immediately. The account is for one person; you may not share it with anyone else. The service is not intended for anyone under 16; by registering you declare that you are 16 or older. If we find otherwise we close the account and refund the unused paid period. ## 4. Plans, credits and prices The credit unit matches the market so you can compare directly: **one neural song of up to 4 minutes = 5 credits**. Procedural music and nature scenes cost **0 credits** (fair daily limits apply). A neural nature texture costs 2. The AI studio tools are priced per action, where the service offers them: extend 4 (8 when it adds more than 90 seconds or grows both ends), repaint a section 4, remix/cover of your own track 5 per started 4 minutes of the source, a variation with the same structure 4, AI stems + MIDI 2 on Studio and included on Pro, a DJ Extended Mix 8, a DJ transition 4, exact BPM 0; each take is priced separately, and a job that fails is never charged. `GET /api/plans` returns the authoritative per‑feature costs of the tools that are available, also shown on the Pricing page. **(pending legal review)** | plan | per month (VAT incl.) | annual billing | credits | ≈ neural songs | commercial use | |---|---|---|---|---|---| | Free | €0 / CZK 0 | — | none — an account without a subscription: **no renders while the paid-only mode is in force**; the library and the downloads of existing tracks stay | — | no (tracks created on it are non‑commercial) | | Basic | **€2.99 / CZK 79** | **€2.49 / CZK 59** per month, i.e. **€29.88 / CZK 708 per year** | 100 / month | 20 | yes | | Studio | **€9.99 / CZK 249** | **€7.99 / CZK 199** per month, i.e. **€95.88 / CZK 2,388 per year** | 500 / month | 100 | yes | | Pro | **€29.99 / CZK 749** | **€23.99 / CZK 599** per month, i.e. **€287.88 / CZK 7,188 per year** | 1,500 / month | 300 | yes | | Top‑up | **€7.99 / CZK 199** per 500 credits (**can only be bought on a paid plan**) | — | 500 | 100 | per plan | Annual billing is charged **once for the whole period** at the "per year" amount; the monthly equivalent is shown for comparison only. The EUR and CZK amounts are **final consumer prices including VAT**; a business customer with a valid VAT ID is invoiced under the reverse-charge scheme, i.e. without VAT. * **Downloads are unlimited on every plan**, including Free (an account without a subscription keeps downloading the tracks it already has). * **Trial without an account.** Anyone may render a **30‑second synthesizer preview** without an account (3 a day per anonymised network‑address bucket, and a daily cap for the whole service). It creates no account and no track, cannot be downloaded, and is **deleted after 24 hours**. It is the only free use of the service. * Prices are shown primarily in **EUR**, additionally in **CZK**; the CZK list is a **separate** price list, not a currency conversion, and the binding amount is the one shown before you confirm the order. The USD list that `GET /api/plans` returns as `price_month` is an internal comparison unit **excluding tax** and is never charged to a consumer. **(pending legal review — updating the price list when exchange rates move)** * Monthly credits **do not carry over**: they are a right to use the service inside the month you paid for. * Top‑up credits **never expire** and **stay on your account after you cancel a subscription**. They can only be spent on a paid plan — an account without a subscription (Free) does not render, so purchased credits are never taken from it. Come back to Basic, Studio or Pro and the balance is available again, unchanged. That is also why a top-up can only be bought on a paid plan: on Free we refuse the purchase rather than sell you something you cannot use. * The **total amount that will be charged** is shown on the Pricing page and in the order summary **before** you place the order — for annual billing that is the amount for the whole year, not the monthly equivalent. * A generation that fails on our side costs no credit; retries inside one job (the novelty gate) count as one. * We protect the platform with limits: a fair daily procedural render limit per plan (30 a day on Basic), a global daily cap on neural generations, and the trial's limits above. A subscription taken out **before 8 October 2026** keeps the procedural studio without a daily limit for as long as it continues without interruption. When a limit is reached the service returns an error and you can try again later. **Price change of 27 September 2026 and existing subscribers.** The prices and allowances in the table apply to every subscription and every purchase made **on or after 27 September 2026**. If you took out a Studio or Pro subscription before that date, you keep paying your original price and keep receiving your original monthly credit allowance (Studio 500, Pro 2,000 credits) for as long as the subscription continues without interruption on the same plan and the same billing interval. If you cancel and later subscribe again, or change the plan or the billing interval (monthly ↔ yearly), the new or changed subscription is at the price list in force at the time of the change. The credit prices of the AI studio tools and the top‑up price in this section apply to everyone. ## 5. Payments and VAT Payments are processed by **Stripe Payments Europe, Limited** (Ireland) — see ; we never receive your card number. Subscriptions renew automatically until cancelled; you can cancel at any time with effect at the end of the paid period. Prices for EU consumers **include Czech VAT** at the standard rate of 21%, whatever the consumer's own country: our cross‑border sales to consumers in other member states stay below the EU threshold, so the supply is taxed where we are established and we are **not registered for the One‑Stop Shop (OSS)** scheme. Should we exceed that threshold we will move to OSS, the rate will then follow the consumer's country, and we will tell you before that happens. Businesses with a valid VAT ID may be invoiced under the reverse‑charge mechanism — enter the VAT ID before payment. An invoice is issued for every payment; it is **issued on our behalf by Stripe Payments Europe** and is available on the Account page and in the customer portal. **(pending legal review — threshold treatment and invoice requirements)** ## 6. Defects If something is wrong with the service (a file will not download, generation repeatedly fails), write to **support@aleatoria.io**. Consumer rights arising from defective performance follow Act No. 89/2012 Coll. (Civil Code). Credits spent on a failure caused by us are refunded. ## 7. 14‑day withdrawal (consumers) If you are a consumer you may withdraw from the subscription contract **within 14 days** without giving a reason (§ 1829 of the Czech Civil Code; Directive 2011/83/EU). **Digital content caveat:** the service is supplied immediately after payment. Before performance starts we ask for your express consent to begin before the withdrawal period expires and for your acknowledgement that you thereby lose the right of withdrawal to the extent performance has been provided (§ 1837 Civil Code, Art. 16(m) of Directive 2011/83/EU). Without that consent we do not start generating. Our practice is more generous than the law requires **(pending legal review)**: | situation within the first 14 days | refund | |---|---| | no credits spent | **100 % of the price** | | some credits spent | the proportional part of the price matching the **unspent** credits | | all credits spent | none (performance provided in full) | Downloading a file does not by itself reduce the refund; only the number of credits spent matters. **For an annual subscription** the proportion is taken from the **whole period paid for**, not from one month: what was agreed is 12 monthly allowances (Basic 12 × 100 = 1,200 credits, Studio 12 × 500 = 6,000, Pro 12 × 1,500 = 18,000). The unspent part is the remainder of the current monthly allowance **plus** every month not yet granted. Example: you pay €95.88 for a year of Studio and spend 250 credits of the first allowance on day three — we refund €95.88 × (6,000 − 250) / 6,000 = **€91.88**. **How to withdraw.** Either with the **"Request a refund"** button on the Account page, which shows the computed amount, or by e-mail to **support@aleatoria.io**; you may use the model form at , though you are not obliged to. **We acknowledge receipt of your withdrawal by e-mail without undue delay** — the acknowledgement carries a reference number, the date it was received and the computed amount, and it is your proof that you withdrew. We refund **within 14 days** of receiving the withdrawal, **by the same means of payment** you used; the refund is executed by a person rather than automatically, so it may take a few working days — never longer than that deadline. Top‑ups (one‑off purchases) follow the same proportional rule; consumption is attributed FIFO, i.e. the oldest pack is spent first. **Closing your account** (`DELETE /api/me`) is not the same as withdrawing: the contract ends on the day you close it, the paid but unused period is not refunded and we cancel the subscription at the payment provider. If you want your money back, withdraw under this section **before** closing the account. **(pending legal review — fairness towards the consumer)** ## 8. Rights to the outputs * **You own what you create.** We grant you a worldwide, non‑exclusive, perpetual and non‑transferable licence to use the outputs you generated, including modification and distribution, to the extent of your plan. * **Free (an account without a subscription): non‑commercial use only** for the tracks created on it. You may not monetise them (streaming platforms, advertising, sale, paid events). **Basic, Studio and Pro: commercial use**, granted **permanently** for tracks created while the subscription was active — those rights survive the end of the subscription. * **Exception — the MusicGen engine** has CC‑BY‑NC 4.0 weights, so its output is always non‑commercial; the service refuses it for commercial jobs on paid plans. The other models (ACE‑Step MIT, HeartMuLa Apache‑2.0, Stable Audio Open under the Stability AI Community License) allow commercial use within their licence terms. * **Copyright uncertainty.** Whether purely machine‑generated content enjoys copyright protection is unsettled in the EU; it is possible that nobody holds exclusive rights to an output. We give no warranty of exclusivity and no guarantee that a similar output will not be produced for someone else. **(pending legal review)** * **AI edits work on your own tracks only.** The AI studio tools (extend, repaint, remix/cover, variation, AI stems and the DJ tools) take as their source only a track created in your own account; uploading your own or someone else's audio for them is not offered. A derived track is a new output: its licence follows your plan **at the time the derived track is rendered**, exactly as for any other track. **(pending legal review)** * **We claim nothing of yours.** We do not use your outputs for training and do not publish them. ## 9. AI content marking Every exported file carries a machine‑readable marking that the audio was created by AI (). **You must not remove or obscure this marking.** If you publish an output as a deep fake or as content informing the public on matters of public interest, you have your own transparency obligation under Art. 50(4) of Regulation (EU) 2024/1689. Honest naming on our side: an immersive ADM BWF master is **"Atmos‑ready", not "Dolby Atmos encoded"** — the final encode is done by licensed Dolby tools. ## 10. Acceptable use You may not: 1. generate content infringing third‑party rights (imitating the voice, name or style of a specific living artist in a way that suggests their involvement; inserting copyrighted lyrics you have no rights to); 2. generate illegal content — hate speech, child sexual abuse material, incitement to violence, deceptive deep fakes of real people; 3. circumvent plan limits and quotas, share your API key, or create accounts automatically; 4. load the service in a way that endangers its operation, or run penetration tests without written consent; 5. reverse‑engineer, extract models, or resell the service as your own (white‑label) without an agreement; 6. remove the AI content marking (§9). On breach we may restrict or close the account; on a serious breach without compensation for unspent credits. ## 11. Availability and changes to the service We promise no specific availability (no SLA). Planned maintenance is announced in advance where possible. Third‑party engines may be temporarily unavailable — the procedural studio always works. Material restrictions of paid features are announced at least 30 days ahead, with the option to cancel and receive a proportional refund. ## 12. Liability The service is provided "as is". We do not warrant fitness of an output for a particular purpose or its originality. We are not liable for indirect damage, lost profit or data loss. Total liability is limited to the amount you paid for the service in the last 12 months. **Statutory consumer rights are unaffected**, and the limitation does not apply to intent, gross negligence or personal injury. **(pending legal review)** Keep your own backups — downloaded files are your copies. **Tracks created on Free and their audio are deleted after 180 days** (stems after 90 days). What counts is the plan the track was **created** on: tracks made on Basic, Studio or Pro are kept until you delete them or close the account (their stems and DJ‑pack versions for 180 days, the same on Basic as on Studio), and **cancelling a subscription changes nothing about them** — the 180-day window of Free is not applied to them retroactively. A trial preview is not a track: it belongs to no account and is deleted after 24 hours. The full retention periods are in §7 of the privacy policy (). ## 13. Changes to these terms We announce changes by e‑mail or in the app at least **30 days** in advance. If you disagree you may cancel before they take effect and receive a proportional refund for the unused period. Each version states the date it was issued and the date it takes effect (see "Version history" above). **A price change of a running subscription** is announced by e‑mail at least 30 days in advance and applies no earlier than the first billing period that starts after that notice period; for a yearly subscription therefore never in the middle of a paid year. Until then you may cancel the subscription at the end of the current period. **(pending legal review)** ## 14. Governing law and disputes The contract is governed by the law of the Czech Republic. For consumers this does not affect the mandatory rules of the country of their habitual residence. We will try to settle disputes amicably; a consumer may turn to the **Czech Trade Inspection Authority** as the out‑of‑court dispute resolution body ([adr.coi.cz](https://adr.coi.cz/)). Otherwise the courts of the Czech Republic have jurisdiction. ## 15. Personal data How we handle data is described in the privacy policy () and in the technical record (). If you are a business processing your own customers' personal data through Aleatoria, we will conclude the data processing agreement () with you.
